Maurice Blackburn Pty Limited (ACN 105 657 949) (Maurice Blackburn) of Level 21, 380 La Trobe Street, Melbourne VIC 3000, Australia, in its capacity as escrow agent and acting under the specific instruction of the data controllers, being:


Chapelton B.V. (Company number: 66896924), incorporated under Dutch law, having its registered office at Iconic Offices - The Lennox building, Richmond Street South, Saint Kevins, D02 FK02, Ireland has designed and developed this portal in order to collect and process your personal data on behalf of the Controllers for the purposes set out in paragraph 2 of this collection notice.


The purpose of this privacy notice is to provide you with the information required by Articles 13 and Article 49 of the European Union General Data Protection Regulation about processing your information for the purposes set out in paragraph 2 of this privacy notice tailored to the Trucks Settlement.

 

2.       Purposes of processing


On behalf of the Controllers, Maurice Blackburn (in its capacity as escrow agent) will process the information collected through this portal for the following purposes:


Failure to provide Maurice Blackburn with the information requested may result in delays in processing your payment or us being unable to process your payment.


Your information will not be used for any automated decision making or profiling purposes.

5.       Disclosure of personal data


There may be situations where Maurice Blackburn and/or the Controllers consults overseas-based experts and/or law practices regarding your matter or the matter may be funded by an overseas-based litigation funder.


Maurice Blackburn and/or the Controllers may also engage overseas-based services providers. In those circumstances, Maurice Blackburn may disclose information about you to entities outside of the European Economic Area (EEA), including Australia (please refer to section 6 for further detail regarding overseas transfers of personal data).

 

6.       International transfer of personal data

 

For the purposes outlined in section 2 of this collection notice, it is anticipated that your personal data will be transferred to, and/or processed by, Australian financial institutions such as banks and an independent data verification expert, also located in Australia.


Where applicable, Maurice Blackburn and the Controllers will have in place appropriate safeguards to ensure an adequate level of data protection where your personal data is transferred outside of your country or jurisdiction.


This may include Maurice Blackburn and/or the Controllers entering into data processing agreements (that includes the Standard Contractual Clauses adopted by the European Commission) (DPA) between each other and with the overseas recipients.


In the absence of the usual safeguards, such as a formal DPA being executed between the parties in relation to a particular data transfer and where neither of art. 49 GDPR derogations for specific situations do not apply, Maurice Blackburn and/or the Controllers will seek warranties from the overseas recipients that they will process your personal data in accordance with any applicable data protection laws.
